Optional Forms
Summons
Plain summons used when filing together with a Verified Complaint (Form UD-2). Used as an alternative to the Summons With Notice (UD-1).
Sworn Statement of Removal of Barriers to Remarriage
Required when the parties were married in a religious ceremony (DRL Section 253). The plaintiff swears they have taken or will take all steps within their power to remove barriers to the defendant's remarriage (e.g., Jewish 'Get'). Must be served on the defendant. Not required if the defendant signed UD-7 and checked Box 6b.
Affidavit of Defendant
Used when the defendant agrees to the divorce. The defendant waives the right to answer and consents to the divorce proceeding. When signed, it eliminates the need for formal proof of service (UD-3) and the barriers to remarriage statement (UD-4 if Box 6b is checked).
Maintenance (Spousal Support) Guidelines Worksheet
Used to calculate the guideline amount of spousal maintenance based on the statutory formula under DRL Section 236(B)(6). Required when maintenance is being requested or waived.
Settlement/Separation Agreement
Written agreement between the parties covering property division, spousal maintenance, child support, custody, and visitation. Required for uncontested divorces. Must be signed by both parties and notarized. Filing fee of $35.
